Abstract
This paper proposes an analysis of the heterogeneity of damages awarded by insurance companies and judges. Data concerning non fatal injuries related to road accidents that occurred in France over the 2002-08 period are used. The model shows three important outcomes. Firstly, the awards for incapacities (Pretium doloris, aesthetic damage and loss of amenities) are not independent from each other. Secondly, victims’ characteristics have a strong influence on the amount of paid damage. Thirdly, territorial inequalities for damage are residual when compared with the total amount paid to the victim.
